TERMS AND CONDITIONS OF SALE
Agreement
This agreement is between Superior Rotomoulding and the Customer. On acceptance of this quotation, the Customer agrees to be bound by the terms of this agreement.
Terms of Payment
All customer account terms are prepaid unless a trading account has been authorised. We accept payment by bank transfer or credit card. Credit card surcharges apply (1.15% for Visa/Mastercard, 1.5% for Amex). A deposit of 50% of the order total may be required for new customers, and for existing customers placing an order greater than $25,000. This deposit is payable at the time of order with the balance due prior to despatch.
Lead Time
Normal lead time is 15-20 working days, however this may vary between products.
Order changes and cancellation
All products are manufactured to order and as such, once manufacturing has commenced, orders cannot be cancelled or changed.
Returns and Refunds
All products are manufactured to order and as such, are non-refundable and cannot be returned unless they are faulty.
Delivery Terms
Goods can be collected from 20 Demand Ave, Arundel 4214 between the hours of 7.00am and 3.00pm or transport can be arranged at the purchasers’ cost.
Validity of Quote
All quotes are valid for 30 days.
Limitation of Liability
In no event shall we be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our products and services.
Warranty
- Superior Rotomoulding warrants that the goods supplied pursuant to this contract will be of merchantable quality.
- Superior Rotomoulding will not be liable for any loss, damage, injury or claim by any person arising from the use of the goods supplied hereunder. The Purchaser indemnifies and holds Superior Rotomoulding forever harmless in respect of any claim, suit or demand made by any person arising from any damage or personal injury caused by, through, or in connection with the use of the goods supplied hereunder.
Title and Risk
- Superior Rotomoulding retains title to the works installed until such time as The Purchaser has paid the whole of the Contract price.
- In the event that The Purchaser does not pay Superior Rotomoulding the whole of the Contract price strictly in terms of this Contract, The Purchaser authorises Superior Rotomoulding to enter onto the site address and with necessary machinery, remove the goods without liability to The Purchaser with trespass, negligence or any obligation to pay compensation to The Purchaser.
Notices
Notices to be given by either party shall be mailed or emailed, provided that in the case of an email, the notice will only be considered to have been delivered if the sender of the notice retains an electronically generated confirmation of receipt.
